1. Any claims for product must be communicated by the buyer to nDataStor as follows:

a) If the product is damaged in transit or shipped in shortage within 5 days of product receipt.
b) If the product fails to meet manufacturer's specifications for form, fit and function, notice must be given within 5 days or within payment terms starting on the invoice date, whichever is greater. Our liability shall be limited to the invoiced value of the materials or its replacements.

2. Returns will only be accepted with a valid Returned Material Authorization (RMA) number. nDataStor reserves the right to refund, replace, or credit the buyer’s account.

3. All sales shall be governed by the laws of the state of California, and any action with respect to the order shall be heard solely in California. This confirmation of terms supersedes any conflicting provisions of the Buyer's purchase order.

4. If the Buyer fails to pay, Buyer will be responsible for all reasonable costs and expenses including, but not limited to, attorney fees and monthly finance charge up to 1-1/2% (18% per annum) of the monthly outstanding balance.
